Terms of Service

1. Scope of Work

​D Trickta Design (the "Designer") agrees to provide graphic design, branding, and/or illustration services as outlined in the project proposal or invoice. Any work requested outside of the original scope will be subject to additional fees.

 

​2. Creative Process & Artistry

​All designs, including logos and illustrations, are custom-designed and/or hand-drawn. The Designer’s style is a core part of the service. While the Designer makes every effort to align with the Client’s vision, design is subjective. A difference in aesthetic preference does not constitute a failure of service or a breach of contract.

 

​3. Payment & Non-Refundable Policy

​Creative Labor: Payment is made in exchange for the Designer’s time, expertise, and labor.

​Non-Refundable: Once work has commenced, all payments made—including deposits and progress payments—are strictly non-refundable.

​Final Settlement: In the event of project cancellation by the Client, the Designer shall retain all payments to cover the hours of research, sketching, and development already performed.

 

​4. Revision Policy

​Unless otherwise stated in the project agreement, the Client is entitled to hours of revisions according to chosen design package. Revisions are defined as minor tweaks to the chosen concept. A total change in design direction (a "pivot") after work has begun may be treated as a new project and billed accordingly.

 

​5. Intellectual Property

​Ownership: Upon final payment, the Client receives the rights to the final approved design for its intended use.

​Unused Concepts: The Designer retains all rights to any preliminary sketches, unused concepts, or hand-drawn elements not included in the final approved design. These may not be used, copied, or shared by the Client without written permission.

 

​6. Client Responsibility

​The Client is responsible for providing clear, timely feedback and direction. The Designer is not responsible for delays caused by a lack of Client communication or vague project briefs.
